Terms and Conditions
Fitness to Drive
1) You must hold a valid driving licence (UK provisional, UK full, or international driving permit where legally acceptable).
2) You must be able to read a vehicle number plate from a distance of at least 20 metres.
3) Your instructor reserves the right to terminate a lesson if they believe you are unfit to drive due to the effects of alcohol, drugs (prescribed or otherwise), illness, fatigue, or any condition which may make driving unsafe. In these circumstances, the lesson fee remains payable.
Cancellations & Changes
4) A minimum of 48 hours’ notice is required to change or cancel a driving lesson.
a) Lessons cancelled with less than 48 hours’ notice will be charged in full.
b) Failure to attend a booked lesson will result in the full lesson fee being payable.
c) If your instructor needs to cancel a lesson, a replacement lesson will be offered and compensation may be offered at the instructor’s discretion.
5) If your instructor is delayed due to unforeseen circumstances:
a) Where possible, the lost time will be added to the end of the lesson.
b) Where this is not possible, the time will be carried forward to a future lesson at no extra cost.
During Lessons
6) Lessons will begin at the agreed time and location. If you are more than 15 minutes late, the lesson may be cancelled and charged in full.
7) The use of mobile phones during lessons is not permitted. Phones should be switched off or placed on silent. If you are expecting an urgent call, this must be discussed with your instructor before the lesson begins.
8) Lessons are provided on a one-to-one basis. Additional passengers are not permitted unless agreed in advance, as they may distract from the learning process.
Pricing & Special Offers
9) Learn Smart Driving School does not offer introductory discounts. Prices are set fairly and consistently for all pupils.
10) Instructors may, at their discretion, offer goodwill rewards for customer introductions, such as a free lesson when your referred friend begins paid lessons.
11) Lesson prices may be reviewed and adjusted occasionally due to rising business costs. Any price change will be clearly communicated, with a minimum of 4 weeks’ notice given to active pupils.
12) Any special offers, promotions, or rewards may be amended or withdrawn at any time.
Gift Vouchers
13) Gift vouchers are valid for 6 months from the date of purchase, unless otherwise agreed at the time of purchase.
14) Refunds for gift vouchers must be requested within 28 days of purchase.
Block Bookings
15) Block bookings of up to 10 hours are valid for 6 months from the date of purchase.
16) Block bookings of more than 10 hours are valid for 12 months from the date of purchase.
17) Refund requests must be made within 28 days of purchase.
18) Partial refunds will be calculated as follows:
Original purchase price – £10 administration fee – Hours already used (charged at the standard single-lesson rate) = Refund due
Refunds will be issued to the original payer.
Driving Tests
19) Your instructor must be satisfied that you have reached a suitable driving standard before allowing their vehicle to be used for a practical driving test.
20) On the day of your driving test, you must complete at least one hour of paid tuition beforehand. An additional charge of one hour’s standard lesson fee applies for the use of the car during the practical test.
21) If an insurance claim arises due to an incident during your driving test, you may be required to pay the insurance excess.
22) If your driving test is cancelled due to examiner illness or DVSA issues, You may be able to reclaim certain expenses directly from the DVSA. Your lesson fees remain payable.
23) If your driving test is cancelled due to bad weather, DVSA will normally rearrange your test, however lesson fees remain payable.
Payments & Responsibility
24) Learn Smart Driving School contracts directly with pupils and is responsible for the provision of driving tuition. Driving lessons are delivered by self-employed instructors acting on behalf of the driving school.
25) Online card payments are processed using secure third-party payment systems. Payments are passed directly to the instructor for delivery of lessons.
Limitation of Liability
26) We are not liable for any loss or damage where:
a) there has been no breach of any legal duty on our part
b) the loss was not a reasonably foreseeable consequence of any breach
c) the loss was caused or contributed to by the pupil
d) the loss was caused by circumstances outside of our reasonable control
27) We are not liable for indirect business-related losses including loss of earnings, profits, opportunities, or business interruption.
Instructor Standards & Complaints
28) All instructors follow current DVSA guidelines.
29) All instructors are regularly checked and approved by the DVSA.
30) All instructors delivering lessons on behalf of Learn Smart Driving School will provide a professional service to high standards.
